1. Service Description

Welcome to nmmodulator, a platform operated by nmmodulator that provides users with access to nmmodulator services. 3. Acceptable Use Policy

4. Prohibited Activities

In addition to the Acceptable Use Policy, you agree not to engage in any of the following prohibited activities:

Using the services for any fraudulent or deceptive purpose.
Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
Transmitting any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.

Engaging in any other conduct that restricts or inhibits anyone's use or enjoyment of the services, or which, as determined by nmmodulator, may harm nmmodulator or users of the services or expose them to liability.

Any violation of this section may result in immediate termination of your access to the services, without prior notice, and may subject you to civil and/or criminal liability.

5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of nmmodulator or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal, non-commercial use only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may print or download one copy of a reasonable number of pages of the services for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise contribute content to the services ("User-Generated Content"). By submitting User-Generated Content, you grant nmmodulator a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that the use of such content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights. nmmodulator is not responsible for any User-Generated Content and does not endorse any opinions expressed therein.

nmmodulator reserves the right to remove or edit any User-Generated Content at our sole discretion, without notice, for any reason, including but not limited to violations of these Terms of Service or applicable laws.

7. Payment Terms

Some features of our services may require payment. By using these features, you agree to pay all applicable fees and charges associated with your use of the services. All payments must be made in Euro (€) and are non-refundable unless otherwise stated. You are responsible for providing accurate payment information and ensuring that your payment method is valid and up to date.

nmmodulator reserves the right to change its fees and payment policies at any time. We will provide notice of any changes to our fees and payment policies through the services or via email. Your continued use of the services after any changes to the fees constitutes your acceptance of the new payment terms.

If you fail to make any payment when due, we may suspend or terminate your access to the services until such payment is made. You agree to pay all costs and expenses incurred by nmmodulator in collecting any overdue amounts, including reasonable attorney's fees.

8. Service Modifications

nmmodulator reserves the right to modify or discontinue, temporarily or permanently, the services or any part thereof with or without notice. You agree that nmmodulator will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services. We may also impose limits on certain features or restrict your access to parts or all of the services without notice or liability.

In the event of a significant change to the services that materially affects your use, you may have the option to terminate your account and cease using the services. In such cases, you will not be entitled to any refunds for any fees paid prior to termination.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall nmmodulator, its affiliates, licensors, or service providers, or their respective officers, directors, employees, agents, contractors, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the services, any content on the services, or any services or items obtained through the services, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall nmmodulator’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services. The foregoing limitations will apply to the maximum extent permitted by law in the applicable jurisdiction.

Nothing in these Terms of Service shall limit or exclude liability for death or personal injury resulting from negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10. Termination

These Terms of Service are effective until terminated by either you or nmmodulator. You may terminate these Terms of Service at any time by discontinuing your use of the services and deleting your account. nmmodulator may terminate these Terms of Service or suspend your access to the services at any time, without notice, for any reason, including but not limited to your violation of these Terms of Service.

Upon termination of these Terms of Service, your right to use the services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of your account does not relieve you of any obligations to pay any outstanding fees or charges incurred prior to termination.
